1. Scope
This Privacy Policy governs the collection, use, disclosure, and retention of personal information obtained through cwcboise.com (the “Site”), which is owned and operated by Calm Waters Counseling (“we,” “us,” or “our”). By accessing or using the Site, you acknowledge that you have read and understood this Policy.
The Site is operated from the United States and is intended for users located in the United States. Personal information collected through the Site is stored and processed in the United States.
2. Information We Collect
Information you provide. The Site includes a contact form. Information submitted through that form is collected by us and may include your name, email address, telephone number, and the contents of your message, together with any additional details the form requests or that you elect to include. Information you provide by email, telephone, text message, or other correspondence is likewise collected and retained.
Form submissions are stored in the database of the Site itself, on our hosting infrastructure, and remain accessible to authorized administrators of the Site. A copy of each submission may additionally be transmitted to us by email.
Information collected automatically. Our hosting and security providers record standard technical information in server and security logs, which may include IP address, browser type and version, operating system, pages viewed, referring source, and date and time of access. Comparable technical information, including IP address and browser user agent, may be recorded with each contact form submission for the purpose of identifying and preventing spam and abuse.
Analytics information. We use a third-party analytics service to understand how the Site is used. Information collected for this purpose is described in Section 6.
3. Use of Information
We may use personal information collected through the Site to respond to inquiries and correspondence; to contact you by email, telephone, or text message concerning your inquiry; to provide requested information, quotations, or services; to maintain records of our communications; to analyze usage of the Site and improve its content and performance; to secure the Site against spam, fraud, unauthorized access, and other malicious activity; to diagnose technical problems and maintain the availability and performance of the Site; and to comply with applicable legal obligations.
We do not sell personal information for monetary consideration, and we do not disclose contact information to third parties for their own marketing purposes.
4. Telephone and Text Message Communications
If you provide a telephone number to us, whether through the contact form or otherwise, you consent to being contacted at that number by telephone call or text message (SMS) for the purpose of responding to your inquiry and conducting the business communications it contemplates. Consent to receive such communications is not a condition of purchasing any goods or services.
Message and data rates may be assessed by your wireless carrier. Message frequency varies according to the nature of the correspondence. You may withdraw consent to receive text messages by replying STOP to any message received from us, and may request assistance by replying HELP. Withdrawal of consent to text messaging does not preclude us from responding to you by email or telephone where appropriate.
We do not sell, rent, or otherwise transfer telephone numbers or text message consent to third parties.
5. Caching
The Site employs server-side caching to improve loading performance. Cached copies of Site pages are stored on our hosting infrastructure and served to visitors in place of regenerating each page on request. The caching layer may set cookies for the purpose of determining which cached version of a page should be served to a given visitor, for example to prevent content intended for an authenticated administrator from being served to a general visitor. These cookies contain no personally identifying information and are not used for tracking.
6. Cookies and Analytics
A cookie is a small text file placed on your device by your browser. The Site uses the following categories of cookies.
Strictly necessary cookies. These are set by our hosting, caching, and security infrastructure. They may be used to distinguish legitimate users from automated traffic, to record that a user has satisfied a security check, to support rate limiting and abuse prevention, to determine which cached version of a page is served, and to maintain session state. Additional cookies are set solely for authenticated administrators of the Site and are not issued to ordinary visitors. These cookies are necessary for the Site to function.
Analytics cookies. The Site uses Google Analytics, a web analytics service provided by Google LLC. Google Analytics sets cookies that enable it to record and report information about your use of the Site, which may include the pages you view, the duration of your visit, the approximate geographic region derived from your IP address, the referring source that directed you to the Site, and general information regarding your device and browser. This information is transmitted to and stored by Google. We use it in aggregate form to understand how the Site is used. Google’s handling of information collected through its services is governed by Google’s own privacy policy and is outside our control.
Managing cookies. You may prevent collection by Google Analytics by installing the Google Analytics Opt-out Browser Add-on or by blocking or deleting cookies through your browser settings. Most browsers permit users to view, delete, and block cookies. Disabling strictly necessary cookies may impair the functionality of the Site or prevent completion of security checks.
7. Service Providers and Disclosure
We engage third-party service providers to operate the Site. Our web hosting provider maintains the Site, its database, its cache, and its server logs, and accordingly holds contact form submissions and access log data. Our security, DNS, and content delivery provider filters inbound traffic and processes IP addresses, request headers, and user agent data. Our email delivery provider transmits messages generated by the Site and processes sender and recipient addresses, subject lines, message contents, and delivery logs. Our analytics provider processes the information described in Section 6.
Software used to build and operate the Site, including our content management system, page builder, form software, caching software, and search optimization tools, operates on our own hosting infrastructure.
We may disclose personal information where required or permitted by law, including in response to a subpoena, court order, or lawful request by a governmental authority, or where disclosure is necessary or appropriate to establish, exercise, or defend legal claims, to enforce our terms, or to protect the rights, property, or safety of any person. In the event of a merger, acquisition, reorganization, or sale of assets, personal information may be transferred as part of that transaction.
8. Data Retention
We retain personal information for as long as we consider it necessary to fulfill the purposes described in this Policy, to maintain our business records, or as permitted or required by applicable law. Retention periods vary according to the nature of the information and the circumstances of its collection. Contact form submissions, correspondence, server and security logs, and analytics data are retained in accordance with our internal practices and the configured settings of the applicable service provider. Cached page content is transient and is regenerated or purged in the ordinary course of Site operation.
9. Security
We maintain safeguards that we consider reasonable to protect personal information, which may include encrypted transmission, firewall filtering of inbound traffic, restricted administrative access, and periodic application of software updates.
No method of transmission over the internet or method of electronic storage is entirely secure, and we make no warranty, express or implied, that personal information will remain secure against unauthorized access, disclosure, alteration, or destruction. Users transmit information to us at their own risk and should not transmit sensitive information, including government identification numbers, health information, or financial account details, through the contact form.
10. Privacy Rights
Certain state privacy statutes afford residents of those states rights with respect to their personal information, which may include the right to confirm whether personal information is processed and to access it, the right to correct inaccuracies, the right to request deletion, the right to obtain a copy in a portable format, the right to opt out of the sale or sharing of personal information and of targeted advertising, and the right not to be subject to discriminatory treatment for exercising such rights.
Those statutes apply only to businesses meeting the thresholds each statute prescribes, and the rights they confer are subject to the conditions, exceptions, and verification requirements set out in the applicable statute. Where a statute applies to us and confers a right on you, we will honor that right to the extent and within the timeframe the statute requires.
We do not sell personal information for monetary consideration and do not use personal information for targeted advertising or cross-context behavioral advertising. You may opt out of analytics collection by the means described in Section 6.
Requests may be submitted using the contact information in Section 14. We may take reasonable steps to verify your identity and the legitimacy of any request before responding, and may decline requests that are unverifiable, unfounded, excessive, or that we are not obligated to honor.
11. Children’s Privacy
The Site is directed to a general business audience and is not directed to children under the age of thirteen. We do not knowingly collect personal information from children under thirteen. If we become aware that such information has been collected, we will take reasonable steps to delete it.
12. Third-Party Websites
The Site may contain links to websites operated by third parties. We do not control and are not responsible for the privacy practices or content of those websites. Users are advised to review the privacy policies of any third-party website they visit.
13. Amendments
We reserve the right to amend this Policy at any time and in our sole discretion to reflect changes in our practices, the technologies employed, or applicable law. Amendments take effect upon posting, and the “Last Updated” date above will be revised accordingly. Users are responsible for reviewing this Policy periodically. Continued use of the Site following the posting of an amended Policy constitutes acceptance of that Policy.
